Know all Men by these Presents that We Thomas Oldroyd of Dewsbury in the County of York Attorney at Law, Whitaker Rylah of the same place, Attorney at Law and William Rylah of the same place Attornies Clerk … do stand and are firmly bounden….

22nd November 1828

The conditions of this obligation is such that if the above bounden Thomas Oldroyd by decree of Court Administrator or of all the singular Goods, Chattels and Credits of Michael Hemingway late of Heckmondwike in the parish of Birstall in the County and Diocese of York Clothier, deceased left unadministered by Samuel and John Hemingway both now deceased whilst living the surviving Executors named in the last Will and Testament of the said deceased Limited only so far as related to and concerns the residue and remainder of a certain Terms of one thousand years originally raised and created by or by virtue of by or by virtue of a certain Indenture bearing date 0n or about the thirteenth day of July one thousand seven hundred and fifty eight and made or mentioned to be made between John Fearnley of Gawthorpe in the parish of Dewsbury in the County of York aforesaid Yeoman, a Devisee named in the last Will & Testament John Speight of Gawthorpe aforesaid Yeoman deceased on the one part and William Elmsall of Little Saint Helens, Bishopgate, Street, London, Gentleman on the other part. The said Terms comprising or affecting (inter alia) all that messuage, dwelling house or Tenement situate and standing in Dewsbury aforesaid with Barn, or Stable and other the Buildings, Hereditaments and appurtenances thereto belonging and enjoyed now or later in the occupation of Thomas Smith or his Undertenants and all that Messuage Dwelling House or Tenement in two Dwellings situate and standing in Dewsbury aforesaid with the Hereditaments or Appurtenances thereto belonging now or later in the several Occupations of Mary Pawson and Elizabeth Pawson or their respective undertenants together with all and singular the appurtenances. Which said term by diverse mesne assignments and assurances and other legal Acts and particularly by ---- of a certain Indenture of seven parts bearing date the second day of May which was in the year of our Lord one thousand seven and hundred and eighty six made between Charles Pollard in the said County of York Gentleman of the first part Thomas Gile of Notton in the parish of Royston in the said County, Gentleman and John Lyle of Thornhill aforesaid, Gentleman surviving Executor named and appointed in and by the last Will and Testament of John Wilcock late of Overshitlington in the said parish of Thornhill Gentleman deceased who was the surviving Executor of the last Will and Testament of William Wilcock late of Thornhill aforesaid Gentleman deceased of the second part Anthony Fearnley of Hanging Heaton in the parish of Dewsbury aforesaid Clothier only son and heir at Law of Matthew Fearnley late of the same place deceased who was surviving  devised and forenamed in the last Will & Testament of John Fearnley late of Dewsbury aforesaid Yeoman also deceased of their part Elizabeth Sprouson[?] of Dewsbury aforesaid widow of the said John Fearnley of the fourth part John Smith of Bowd Royd in the parish of Dewsbury aforesaid Clothier of the fifth part and John Lancaster of Dewsbury aforesaid, Carrier and the said Michael Hemingway his Executors and Administrators and his Assigns in order to enable him to assign the said Thornes[?] Closes or surrender the residue of the said Terms the said John Hemingway having survived the son of Samuel Hemingway but having died Intestate………do make or cause to be made….
