Samuel Hemingway, Heckmondwike, 25 June 1811

 

In the name of God, Amen.  This is the last Will and Testament on Samuel Hemingway of Heckmondwike in the parish of Birstall in the County of York, Farmer which I now make, publish and declare this Twenty fifth day of June in the year of Our Lord one thousand, eight hundred and eleven whilst I am of sound and disposing mind memory and understanding in manner and in manner, that is to say.  First it is my will and mind that all my just and Honest debts.  Funeral expenses and probate of this my Will be first be paid and discharged of my Estate and Efforts of my Executors and Trustees hereinafter named and from and after my decease I do hereby give, devise and bequeath All my Freehold Estates, closes of land, hereditaments and premises with therein and each and every of their rights, members & appurtenances thereby belonging of therewith occupied situate standing lying or being at Dewsbury Moorside in the said County of York and Heckmondwike aforesaid  And also all my personal Estate whatsoever and wheresoever the same be unto my loving wife, Grace Hemingway to hold to may said wife Grace Hemingway and her Assigns during the Term of her natural life, and from after the decease of my said wife, then it is my will and mind that my Executors and Trustees shall sell and dispose of my Freehold Estate and Personal Estate for the best price that may be gotten for the same and the money from such sale or sales be equally divided amongst my children share and share alike. Also I give and bequeath unto my Daughter, Mary the sum of twenty seven pounds.  Also I gave and bequeath to my son Matthew --- Hemingway the sum of twenty nine pounds which said several legacies I hereby order and direct to be paid to them respectively as they shall attain the age of twenty one years.  And lastly I do hereby make ordain constitute and appoint my sons Michael Hemingway, John Hemingway and Joseph Hemingway joint Executors and Trustees of this my last Will and Testament. And I do hereby revoke and make void all other Will or Wills heretofore by me made and I do declare this to be my last Will and Testament.  In Witness thereof I have to this my last Will and Testament set my hand and seal the day and year first above written.

A true and perfect Inventory of all and singular the Goods, Chattels and Credits of Samuel Hemingway late of Heckmondwike in the parish of Birstall in the Diocese of York Farmer deceased made and exhibited by me Michael Hemingway the son and one of the surviving Executors in the last Will and Testament of the said deceased

I do hereby certify on the eighth day of November in the year of our Lord 1813 Michael Hemingway of Liversedge Park in the parish of Birstall in the County of York Farmer, son and one of the surviving Executors named in the within written Will of Samuel Hemingway late of Heckmondwike in the parish of Birstall aforesaid in the Diocese of York Farmer deceased was Sworn duly to execute and that the whole of the Goods Chattels and Credits of the said deceased within the Diocese of York do not amount in value to one hundred pounds
