Edward HEMINGWAY of Clayton  :  1729

 

In the name of God the fifth day of November in the year of our Lord 1729 I Edward Hemingway of Clayton in the Parish of Bradford in the County of York Yeoman Do Make and [ ] this my Last Will and Testament in manner and form following (that is to say) First I bequeath my soul into the hands of Almighty God believing remission of sins and everlasting life by the [ ] death and passion of Jesus Christ my Lord and Saviour. Item I give and devise unto Daniel Hemingway my son all that messuage or Tenement Situate Standing and being in Clayton aforesaid now in the possession of me and my said son with all Barns Outhouses and Buildings thereto belonging and also those two closes of Land also thereto belonging and therewith Enjoyed called or known by the name or names of the Hough Close and Spoutt Jug to [ ] unto the said Daniel Hemingway for and During the Term of his natural Life and after his death to all the children of Martha daughter of me the said Edward Hemingway and their heirs and assigns forever yet nevertheless to stand Charges with the yearly payment herein after mentioned (to witt) with the yearly payment of five pounds of lawful money of Great Britain unto the said Martha Daughter of me Edward Hemingway or her order on Every Feast of Pentecost and St Martin the Bishop in Winter by two equal portions the first payment thereof to begin and be made on either of the said Feasts which shall first happen after my demise during the term of her natural Life with which said yearly payment I do hereby Charge and [ ] all and Singual the persons above mentioned  And if Default happen to [ ] in payment of the said five pounds or any part thereof  at either of the said Feasts above mentioned during the natural Life of her the said Martha it shall and may be lawful to and for her to enter into all and singular those said persons and to demand the rents and profits thereof until what shall be then in arrears be fully paid and satisfied together with all reasonable costs and charges laid out or expended in or about the land. Item I give and bequeath unto the said Martha her executors [ ] and assigns my Best Bed and Bedding thereto belonging for ever. Item I Nominate and Appoint my said son Daniel Hemingway to be executor of this my last Will and Testament to whom I give all the rest of my Goods and Chattels after my debts and Funeral Expenses first paid and discharged in Witness whereof I the said Edward Hemingway the Testator have set my hand and seal the day and year first above written
