In
the name of God, Amen the 28th day of March in the year of our Lord 1711 I
Edward Hemingway Blacksmith of Beeston Pitt Hils in the parish of Leeds in the
county of York being very sick and weake of body but in perfectt mind and
memory thanks be to God I therefore calling to mind the mortality of my body
and knowing thatt itt is appointed for all men to do and ordain this my last
will and testament thatt is to say principally and first of all I give and
recommend my Soule to the hands of the Almighty God that gave itt to me and for
my body I recommend it to the earth to
be buried in Christian like and decent maner.
As for the discretion of my Executors nothing doubting butt
at the Generall Resurrection I shall receive some of ----- again by the Mighty
power of God and as concerning my worldly goods and estate where with itt hath
pleased God to bless me in this life I give and dispose of the same as in the
following manner and form
Inmprimus I give and bequeath unto Ann My dearly beloved
wife one close of land to her and her and one house situate for ever so with of
late by James Feather of Oulton being arable land pasture or meadow ground
commonly called by the name of Toberans (?) situate lying and being in
Woodlesford in the parish of Rothwell aforesaid containing five acres by
estimation more or less and now in the use and occupation of the said John
Fether.
Item I give unto my wife Ann one hundred pounds which is now
in the hands of the said John Fether likewise I give unto my wife Ann forty
pounds which is her own
In addition and likewise I give her all my goods and chattel
Likewise I make her sole Executrix likewise I give unto my
sonne Edward one acre of land lying in Houmsley likewise I give him one shop
and orchard adjoining itt to him and his heirs for ever likewise I give him all
my shop tools likewise I give unto my wife Ann one stall which is in Rothwell
church to have in her disposing and I hereby wholly destroy all other wills and
testaments

The Condition of this Obligation is such, that is the above
bounden Ann Relict and sole Executrix of the last will & testament of
Edward Hemingway, late of Beeston of Leeds in the diocese of York , yeoman
deceased do well and truly execute and perform the said will
And do pay his debts and legacies as far as his goods will
extend and law shall bind her if also she do exhibit into the Exchequer Office
in York a true and perfect inventory of all and singular the goods, rights,
credits, cattels and chattels of the said deceased , and do make a true and
just account of the same when she shall be thereunto lawfully called. And
moreover if require, enter into further Bond, as the judge of the said Court
for the time being shall think requisite and needful. And lastly do have,
defend and harmless keep the above named Commissary and all his officers and
ministers against all persons by reason of the premises. Then this present
obligation to be void and of none effect or else to remain in full force and
virtue
