In the name of God Amen. This eighteenth day of April in the year of our Lord God Almighty
to our English Computation 1689 I Daniell Hemingway
of Claiton in the parish of Bradford in the County of
Yorke Yeoman being sick in body but of a sound minde and of a disposing memory [ ] to God doo make and
ordain this my last will and testament
in manner and forme following; And first and
principally I humbly commend my soule into the hands
of Almighty God my Creator And my body to the earth; And as touching the
disposing of my personall estate First my will and minde is that all my lawful debts and funerall
expenses be first paid out of the same And all the clear remainder of my goods
and Chattells I doo hereby give unto Martha Hemingway
and Mary Hemingway my two daughters to be equally divided betwixt those two;
And whereas I have formerly by deed of ffeoffment [ ]
all my lands in Clayton aforesaid to the use of the said Martha and Mary
Hemingway and their heirs, now my will and mind is that if the said Martha
Hemingway and Mary Hemingway my daughters shall fortune to dye in their
minorities without lawful Issue of their bodyes; That
then my said land in Clayton aforesaid shall be to the use and [ ] of Edward
Hemingway of Clayton aforesaid and Michaell Hemingway
of Bradford my brethren, And to their heirs and Assigns for ever to be equally
divided betwixt them two, And the survivor to take none advantage against the
Issue and Assignes of the other; Furthermore I doo
hereby give the tuition of the above said Martha and Mary Hemingway my two
daughters, And all their lands and goods unto the abovesaid
Edward Hemingway my brother and unto John Hirst of
Clayton aforesaid [ ] untill my said daughters shall
have accomplished the age of twenty and one years hopeing
that they will deal faithfully and see to their pious education; And lastly I
doo hereby nominate and appoint the said John Hirst
and Edward Hemingway joint executors of this my last will and Testament; And I
doo hereby revoke all former wills by me made and doo ordain this may last will
and testament; In witness whereof I have herewith set my hand and seale the day and yeare first
above expressed.
