Michael Hemingway of Bradford  :  1694

 

In Dei Nomine Amen I Michaell Hemingway of Bradford in the County and Diocese of York being infirm of body but of sound mind and disposing memory do make and ordain this my Last Will and Testament in manner and form following That is to say first I Commend my Soul into the hands of Almighty God hoping through the merits and intercession of Jesus Christ my Saviour for the free pardon of my sins and my body I commit to the ground to be buried at the discretion of my Executrix hereafter nominated in decent and Christian burial And as touching such worldly estate wherewith it hath pleased Almighty God to Bless me I give and bequeath and dispose of the same as followeth Imprimato I will that all my lawful debts be payd and funeral expenses discharged out of my whole estate Item I give and bequeath to Michaell Hemingway Edward Hemingway and Thomas Hemingway my sons each of them twenty pounds of lawful money of England to be payd when they shall attain to their several and respective ages of twenty one years Item I give and bequeath to Elizabeth Nicholson my daughter in law five pounds of like money to be payd at the decease of Elizabeth Hemingway my wife Item I give and bequeath to William Nicholson my son in law five shillings of like money I give and bequeath to Elizabeth Hemingway my beloved wife all the residue of my goods chattels and worldly estate whom also I hereby constitute and appoint my sole Executrix of this my last Will and Testament Item I hereby annull and revoke all former Wills by me made and ordain this my last Will and Testament In Witness whereof I have hereunto sett  my hand and seal the twenty fifth day of February in the fifth year of the reign of our Sovereign Lord and Lady William and Mary by the Grace of God over England our King and Queen Defender of the Faith and in the year of our Lord one thousand six hundred and ninety two

The Condition of this Obligation is such that if the above bounden widow Elizabeth Hemingway sole Executrix of the last Will and Testament of  Michaell Hemingway of Bradford in the Diocese of York deceased do will and truly execute and perform the sayd will And do pay his Debts and Legacies so far as his Goods will extend and Law shall bind her If also she do Exhibit into the Exchequer office at York a true and perfect Inventory of all & Singular the Goods Rights Cattels and Chattels of ye said Deceased and do make a true & Just Account of ye same when she shall be thereunto lawfully called. And moreover if need require, enter into further Bond  with more and sufficient sureties for Performance of the Premises as the Judge of the said Court for the time being shall think requisite & needful. And lastly do save defend and harmless keep the above named Comissary and all his Officers and Ministers against all Pesons by reason of the Premises. Then this present Obligation to be Void and of none Effect or else remain and be in full Force and Virtue
