Daniel HEMINGWAY of Mile End, Middlesex :  1788

 

In the Name of God Amen I Daniel Hemingway of Spital Street in the hamlet of Mile End New Town in the County of Middlesex Victualler being weak in body but of sound and disposing mind memory and understanding thanks be given to Almighty God for the same Do make and publish this my last Will and Testament in the following (that is to say) first and principally I recommend my Soul to God that gave it my Body I commit to the earth to be decently intered at the discretion of my Executors herein after named and as to my worldly estate and effects which it has pleased God to bestow on me I give and dispose thereof as follows (that is to say) after payment of all my just debts funeral expenses and the expenses of proving this my Will. I give and bequeath to my son Daniel Hemingway all those my three leasehold messuages being part of five leasehold messuages or tenements situate standing and being on the left side of White Village in the parish of Saint Matthew Bethnal Green in the County of Middlesex to hold to the said Daniel Hemingway his executors administrators and assigns for and during the residue and remainder of the term in and by the said lease granted subject to the payment of a proportionable part of the ground rent of the said five messuages and also subject to the covenants in the lease and under which I hold the same. I give and bequeath to my said son Daniel Hemingway all such household goods utensils in trade and all such other things as are now standing and being in and about my house and premises in North Street Spitalfields now occupied by him. I give and bequeath to my trustees Edward Clark of Wheeler Street Spitalfields auctioneer and Charles Poole of North Street Spitalfields aforesaid Butcher all that my freehold messuage or tenement situate standing and being at Harrow on the Hill in the County of Middlesex and all those my two copyhold messuages or tenements situate standing and being at Txxxham Green in the said County of Middlesex and also all those my two leasehold messuages or tenements being the two last of the said five messuages or tenement on the left side of Whites Village aforesaid and also all that leasehold messuage or tenement situate and being on the right side of Whites Village aforesaid In Trust that they my said trustees or the survivor of them and the heirs executors and administrators of the survivor do and shall from time to time receive the Rents xxx and profits of my said freehold copyhold and leasehold estates as the same shall from time to time become due and payable and on receipt thereof to pay the same to my poor wife Ann Hemingway for the support and maintenance of herself and also for the support and maintenance  and education of my two sons Thomas and John Hemingway for and during and until they shall respectively attain their respective ages of twenty one years  and her Receipt alone notwithstanding any future coverture shall from time to time be a sufficient discharge to my said trustees for the same and in case of the death of my said wife Then my said trustees to pay and apply the same in manner as aforesaid for the benefit of my said two sons Thomas and John Hemingway or the survivor of them and in case of the death of both my said sons then my said trustees to pay the whole of the said rents and profits of my said freehold and copyhold and leasehold estate to my said wife Ann Hemingway for her own sole use and benefit as aforesaid all the rest residue  and remainder of my personal estate and effects of what nature kind or quality the same may be and consist of at the time of my decease and not hereinbefore given or disposed of. I give and bequeath the same to my said wife Ann Hemingway to and for her own sole use and benefit. And it is my will and mind that my said trustees shall not be answerable or accountable for any more monies than they shall actually receive nor liable for any loss that my happen to my said Estate (unless by their won wilful neglect) nor shall they or either of them be answerable for the acts or receipts of the other of them but each of them for his own acts and receipts only and that they shall and may retain and reimburse themselves all such costs charges and expenses as they or either of them shall or may sustain or be put unto in the execution of the trusts hereby in them reposes in any manner whatsoever and do hereby nominate and appoint my said wife Ann Hemingway and the said Edward Clark and Charles Poole  joint Executors and Executrix of this my last Will and Testament hereby revoking and making void all other and former will or Wills by me at any time or times herebefore made satisfying and confirming this to be may last will and Testament xxxxxx whereof I have to this my last Will and Testament contained in two sheets of paper to the first sheet thereof set my hand and to the last sheet my hand and seal this twenty fourth day of June in the twenty eighth year of the Reign of our Sovereign George the third by the grace of God of  Great Britain France and Ireland King Defender of the faith and so forth and in the year of our Lord one thousand seven hundred and eighty eight Daniel Hemingway
