Edward Hemingway of Cawthorne  :  1822

 

In the name of God Amen. I Edward Hemingway of Cawthorne in the county of York Joiner being weak of body but of sound and disposing mind memory and understanding do make and ordain this my last Will and Testament in manner and form following that is to say first I will and direct that my just debts funeral expenses and the charge and expense of obtaining the probate of this my last Will and Testament by my Executor hereinafter named and appointed Then I give and bequeath unto my daughter Elizabeth Fearne her Heirs and Assigns absolutely for ever the sum or legacy of thirty pounds to be paid by my Executor hereinafter named and appointed on the expiration of twelve calendar months next after my decease Then it is my will and I do hereby expressly desire that my Executor hereinafter named and appointed shall keep support and maintain my Dear wife Ann Hemingway if he survive her so long as his circumstances shall permit but she should keep my widow but should she marry again then my will is that it shall be at his own discretion whether to allow her anything or not The rest residue and remainder of my effects whatsoever and wheresoever and of what nature kind or quality that so ever I have a wish to dispose of at the time of my decease I give devise and bequeath unto my son Edward Hemingway his Heirs and Assigns absolutely for ever and I do hereby nominate constitute and appoint my said son Edward Hemingway Sole Executor of this my last Will and Testament hereby revoking and making void every other Will heretofore made by me and do declare this to be my last Will and Testament In witness whereof I hereunder set my hand and seal this twenty fist day of May one thousand eight hundred and twenty one

I do herby certify that on the first day of January in the year of our Lord 1822 Edward Hemingway of Cawthorne in the County of York Joiner son and Executor named in this last Will and Testament of Edward Hemingway late of Cawthorne aforesaid joiner deceased was sworn well and truly to execute the same and that the whole goods chattels and effects of the said deceased within the Diocese of York do not amount in value to the sum of one hundred pounds
